    <title>Prudence in speech and allegations</title>

There seems to a substantial section of our society who believe in complete 
freedom as regards their use of words- proper or improper, temperate or 
intemperate, substantiated or unsubstantiated. 

A few months 
ago I and wife Nutan had sent a complaint to enquire into alleged 
collection of money through Sahara Q shop Unique Products Range
Limited, Registered office-Mumbai scheme against the provisions 
of law, basing ourselves on certain facts.

In his reply, Director, Sahara Q shop not only denied the charges, he made a counter 
allegation that we are acting with vested reasons to get Companies 
operations de-established and are White-collar extortionist.

We
 sent legal notice twice requesting the Director either to present facts
 in support of his statements so as to explain why he made such 
allegations or to seek unconditional apology. No response came.

To this Nutan has registered an FIR against Director, Sahara Q Shop, 
Mumbai under section 500 IPC related with defamation for using 
inappropriate words without substantiating them with reasons.

Would like to get your reaction to this chain of events.

Happy Birth Day to Amitabh Thakur 

Amitabh Thakur was born on 16 June 1967 but keeping in tradition the 
Bihari style of saving a few years so as to have as many extra years in 
the Government job that he would later enter, as he actually did when he
 joined the Indian Police Service in the year 1992, he had an official 
reincarnation on 16 June 1968. 

Thus Amitabh lived in a state of "to be born next year" between 16 June 1967 and 15 June 1968 and thus finally and truly 
he arrived for all the official documents on 16 June 1968.

Summing it up, 1967 or 1968, the fact remains that 16 June of the 
English Calender, which is the 167th day of the year (168th in leap 
years) in the Gregorian calendar, on which Ford Motor Company was 
incorporated in 1903 and IBM in 1911, as also the date on which in 1904 
Irish author James Joyce begins a relationship with Nora Barnacle and 
subsequently uses the date to set the actions for his novel Ulysses; 
this date now being traditionally called "Bloomsday" because of this 
historic act, Amitabh also bloomed on two different occasions- one in 
reality and other officially. 

You may wish him happy Birthday 
if you feel like, with a rider that wish him good wishes only when you 
have a true and genuinely affectionate feeling towards him.

Wishing a very Happy Birthday and Father's Day to u papa

16th June 2013, an ordinary day like another and yet holding a special 
relevance to me. Most would know that it is the Father’s Day today, but 
apart from this, it also happens to be my father’s birthday. Come to think of it, most of the times it is hard for me recall my own 
birthday...and yet there are some days which are significantly imprinted in my mind, papa’s birthday being one of them. It obviously happened 
many years before I was born and logically speaking since I was not 
there to witness the event, it shouldn’t be as important to me. And 
despite this, somehow 16th of June seems to hold an unusual place in my 
heart, same as my does my mother’s birthday and their anniversary.

The only plausible reason I can gauge for this is that I owe my being 
to these dates. It is only coz of my parent’s birth and their subsequent
 marriage that I live and breathe; and that I think would be the cause 
of my fascination with these days. This year the coinciding of 16th with
 father’s day makes it all the more momentous to me.

Father’s 
Day as per Wikipedia is ‘a celebration honoring fathers and celebrating 
fatherhood, paternal bonds, and the influence of fathers in society’ and
 ‘was inaugurated in the United States in the early 20th century to 
complement Mother's Day in celebrating fatherhood and male parenting.’ 
Although if you ask me, I really don’t feel that there was any need to 
dedicate a specific day to honour fathers, or even mothers (not because 
it is not worth it, for of course it is). No day can really denote and 
represent in totality what the parents are for a child and what the 
child is to them; and nor can showering love on your parents for one 
single day of the year make up for all those other days when you might 
have neglected them. And regardless of this moral preaching, I am not in
 the least immune to the trend.

Moving on from dates and days, 
lemme now speak on the man whose presence makes them worth speaking 
about. All of us without a doubt love our parents a lot (not speaking of
 some less fortunate ones) and I’m no exception. When I think back to my
 childhood, the first memory of papa which comes to me is him carrying 
me around, while I stood on his feet and the next would be him and mummy
 singing lullaby’s together for my brother and I. There are many others 
which flash before my eyes in a jiffy, overwhelming me with all sorts of
 emotions entangled together. These are moments when I’ve loved him to 
death and also simultaneously, instances when I’ve hated him with the 
same intensity. Loved- that is understandable after all I’m talking 
about my dad; I am bound to love him obviously. But it is not just this 
social binding which makes me love him; it has more to do with the sort 
of a person he is, kind-hearted, generous, intelligent, caring and the 
list goes on. (I won’t dwell deeper on it, as coming from me this might 
sound more of a self-praise than anything else.) Hatred- now this is not
 something about which I should be proud of, and I clearly am not. 
Harboring such negative emotion towards him, even for a second has been a
 mistake, a grave one at that. Albeit on second thoughts, each child 
during his/her growing period must have gone through these phases of 
revolts and rebellions, all without a cause; and each of them must have 
regretted it in the same manner as I.

Dad has definitely always
 been the best father I could have ever dreamt of...I on the other hand 
have never quite been the daughter he would perhaps have wanted. And 
despite all my imperfections, temper, laziness, lethargy he does not 
love me any less. Sometimes I even feel he loves me a little more than 
my brother, a fact which is denied fervently no doubt, but (sorry Addy),
 the denial does not make it any less true.
They say that a father 
is his son’s first hero, and daughter’s first love. All I would like to 
say is that for me, dad is not simply my first love but also very well 
fits the bill of being my first hero (perhaps the last one too).

There would be many more father’s day and many more birthdays, but for 
this once, I want to make him a promise, a promise to fulfill all the 
dreams he has seen for me, all the aspirations he has catered since the 
day I was first placed in his arms, a promise to achieve what many would
 deem unachievable. And though I’ve been told many a times by dad 
himself that I shouldn’t aim at attaining something just because he 
wants me to, I don’t think any accomplishment of mine would be devoid of
 a desire to first please him……after all at the end of the day I would 
always be Daddy’s little girl.

    <title>FIR against Godman Brahmrishi Kumarswami of Lakshmi Narayan Dham</title>

Today my children Tanaya and Aditya registered an FIR
against a Godman Brahmrishi Shri Kumarswami in Gomtinagar Police Station under
the Sections 419, 420 of the IPC and Section 7 of the Drugs and Magical
Remedies (Objectionable Advertisements) Act. Sri Kumarswami is a spiritual
leader who runs an organization known as Bhagwan Shri Lakshmi Narayan Dham.


The FIR alleges that Sri Kumarswami makes various
tall claims such as having more than 310 million followers including even Queen
Elizabeth. His other claims include the New York Senate declaring a day after
his name, a multi-step clinical test conducted on him at a Ministry of Science
and Technology research lab in Bangalore, his medicinal powers being relayed by
BBC, saving Bill Clinton’s chair etc.

Finding these claims dubious and suspicious, the
two had earlier sent a legal notice to Sri Kumarswami asking him to explain his
situation but no reply came from the Godman.

Sri Kumarswami has also been advertising in
newspapers that he has treated people of ailments and diseases such as
deafness, blindness, AIDS and cancer. Advertising such claims is an offence
under Drugs and Magical Remedies (Objectionable Advertisements) Act.

I, along with wife Nutan, have requested the Prime Minister of India for suitable Government Bodies for
 Astrologers and God-men. We have said that in India there are a very 
large number of Astrologers and God-men or religious entities exerting 
great influence on people. Since most of them seek money from the people
 in one form or another in lieu of their services,hence it makes them some kind of professional entities. 

Thus  like every other profession including Medicine, engineering, 
dentistry, law, architect etc,  these works also need a regulation and 
control at various levels, so as to safeguard interest of common people 
and to stop entry of imposters and cheats. 

Hence we have 
asked for formation of two separate Professional bodies at National and 
Regional levels respectively for Astrologers and God-men to act as 
Regulatory and controlling authorities. We want these bodies to consist 
completely of astrologers and God men only with no government 
representative in them. We have proposed that these bodies shall be 
evaluating their genuineness and fitness to practice their art and 
science and only after this verification shall these people be allowed 
to practice. 

We have sought these proposals across all religions and creeds and not to be limited to a particular religion.

How do u react to these proposals?

Friends,

In two cases, I asked for copies of two letters of the State Government dated 
15 February 2012 and 27 June 2012 which were mentioned repeatedly by IG 
Karmik in her letters dated 15  May 2013  denying me information 
previously.

To this I got a reply from IG Karmik that if I 
want to get a copy of these letters, I shall contact the State 
government itself, meaning thereby that the office would not provide it. The reply did not say why the information would not be provided- 
whether it was not available in their office or was it restricted 
information under the Act. 

I found this reply completely 
against the provisions of the RTI Act and hence have presented two 
complaint before the Chief Information Commissioner under section 18 of 
the Act pointing several previous instances to seek appropriate penalty 
against the alleged wrong doing. 

Do fail to understand why many officers feel the law of the land does not apply to them? Till how long in Independent India? And why do we accept these self-drawn conclusions?

I present a write-up I have written on the occasion of 20 years of my marriage. As far as I know, it comes straight from my heart and is as truthful as possible. I am sure some of you would like it and may also find it useful for one reason or another.

07/06/1993- A gets married to N


This is nothing more than a date which came and went. Not many would be remembering when it came and when it passed. 
Just the same way that I am not able to remember most of the other 
dates. A person is able to remember only those few dates which are of 
very special significance to him- either for good reasons or for bad 
reasons. 

07/06/1993, i.e the seventh say of June 1993- a day which I always remember. Not only because I got married that day. Yes, it was important to me that I got married that day but much more 
important is the fact that I got married to Nutan on this particular 
day. Nutan, who today calls herself Nutan Thakur was Nutan Kumari at 
that time. Nutan Kumari because in Bihar, to which I belong, there is a 
tradition of adding the word Kumari (something akin to virgin) to an 
unwed girl’s name. There is a rather special thrust on the virginity and physical isolation of girls in our society and possibly this must be 
the reason for putting this word right at the end of a girl’s name so 
that she always remembers this fact and does nothing which goes to 
violate its sanctity. 

The truth remains that in 
Nutan’s case I never tried to go deeper in this question. It is again 
true that this issue of virginity never really means much to me. On this issue I seem to agree with the views presented by the talented actor 
Tabboo in the extremely sensitively portrayed film Astitva where the 
question of an outsider’s entry (accidental, incidental or otherwise) in a husband-wife relationship has been beautifully and openly discussed. 
My personal opinion on this issue has always been that husband and wife 
shall always endeavour to maintain the sanctity and respect of the 
marital relationship because any extra-marital relationship is bound to 
bring misfortunes and sorrow. But if something happens in disregard to 
this cardinal principle, then it shall be taken as a lesson for the 
future and shall not be made the sole issue for mutual blame-game. This 
is because there is nothing more beautiful, complete and satisfying than husband-wife relationship and it shall not be put on docks unless it 
becomes inevitable. At the same time, I am the first person to advice 
breaking of ties in case it is found that any of the marital partners is indulging in acts of torture, barbarianism or tormenting.  


As far as I know, there was nothing of this sort, as far as Nutan was 
concerned. On the contrary, at the time of my marriage I was badly in 
love with a girl (whose name I would not state for the sake of propriety and decency). Even at the time of marriage, the effects were not 
totally gone. It was possibly more of a one-sided affair because the 
girl never paid me the attention that I was showering over her, yet 
post-marriage I was always overburdened with the guilt associated with 
this infatuation. I must openly appreciate Nutan’s self-confidence, 
patient, sensitivity and the ability of forgiveness because the day I 
narrated before her my secret of life in extremely trembling voice and 
loads of burden, it was over for her. She, never for once, repeated it 
and took the entire episode as if there was nothing so important about 
it. 

I would advice everyone, including myself to 
develop the same sense and attitude, of admitting and accepting the 
partner’s alleged faults and errors and of showing love and affection 
when he or she needs it the most because whoever behaves in similar 
fashion will be able to overcome all kinds of conjugal travesties.  

On this special occasion, I would like to share one more fact of my life. 
At the time of marriage, there was no similarity between me and Nutan 
except our mutual weaknesses. I was a very well-read, bookish, 
hypothetical person who lived more in his dreamland than in the 
realities around. Nutan was a person with ordinary knowledge and was 
much more traditional in her attitude, thoughts and action. I always 
exhorted her to come forward to participate actively on various social 
issues but she was completely shy of moving out of the safe confines of 
the house.  I talked of distant things hardly related with me while 
Nutan had nothing to do with them. I was a person half-wrapped in facts 
and half seeped in fiction, who often went tangential in his thoughts 
and had a flair for day-dreaming. Nutan, on the other hand, completely 
rooted on the ground. If there was any similarity between us, it was 
that we were both animated stubborn variety who excelled in fighting 
with each other and had the tendency to never say quits.  

Yes, we did fight a lot in our life. We fought with full fervor and 
animosity. There were occasions when we did not talk for days. There 
were also times when the marriage seemed to be docks. We used extremely 
hurtful, pinching and demeaning statements against each other, more me 
than her, but she also. The entire atmosphere would turn putrid, violent and cloistered. The kids would start feeling the heat of the 
degenerated relations and would be behaving extremely frightened. Yet we remained together all the time. What was interesting was the fact that 
we fought among ourselves and yet did not leave each other in the 
process. The same bed, the same room and fistful fighting going along!  

Nutan did not like many of my thoughts, ideas and actions. But with time, we 
started coming together. We started understanding each other in a much 
better manner. Then a time came when we did not fight for months. And 
now for years, a situation has arisen when all our friends say that we 
think, act and behave similarly. 

One important reason 
for our continuing to love and live together and getting nearer with the passage of time, despite all our differences, was that there was no 
third person (a male or a female) who came in our life. Thus “loving and fighting with each other” became our way of life and this slowly 
resulted in getting more and more closer and nearer to each other- 
mentally and emotionally. Other reason was that despite all these 
fights, we did love each other sincerely. Despite criticizing me on 
various fronts, she would defend me to the hilt if any third person 
tried to find any fault in me. This included even our closest family 
members.  It was me who did not defend her with the same intensity that 
she always showed and I occasionally criticized her as well. 

Only God knows what lies in store and how our future course of life will 
turn and twist. But what I know for sure is that whatever I got from 
Nutan during the last twenty years is the biggest treasure of my life. 
On this very special occasion of my life, I have tried to present some 
of my very personal facts before you in as truthful a manner as I could. While one purpose was to live through these beautiful 20 years, another reason was to present a short (may be boring) lecture on husband-wife 
relationship so that it comes in assistance of certain other warring 
couples.

Yesterday I had sent  an email  as regards a letter written by me yesterday to
Principal Secretary Home as regards the alleged use of abusive words against
Sub Inspector Sri Raghuraj Singh Bhati by SSP Muzaffarnagar Ms Manjil Saini
requestingefforts to be made to form
a new, open and mutually respectful working environment in UP Police. 

Today I came to know of Bhati’s suspension by the
SSP. It certainly surprised me particularly considering the fact that the SI had
serious allegations made against SSP herself. Taking it as a call and my moral
duty, I have written again to Principal Secretary Home saying that prima-facie
this does not seem in consonance with the the Principle of Natural Justice
because the suspension order is being issued by the same officer alleged to
misdemeanor.. 

Hence in the light of directions of the Supreme
Court in Ratan lal Sharma vs Managing Director case and as per the Principles of Natural Justice, I have requested that
the allegations made by Bhatiand the
entire episode shall preferably be enquired by a senior officer, not from the
Police Department. 

The issue I have presented is not limited to an individual or to a State.
It is also not only an issue related with departmental matters but with the
wider purview of Police culture, Police performance and policing in totality. 

Hence any issue of Police reforms, which we badly need and yearn in India,
also needs to cater to the subordinate-senior relationship and the general
issues of hierarchy and power-distance that police in India presently suffers a
lot. 

These individual efforts are meant exactly for that.

    <title>Letter for creation of better Policing working environment</title>

Today I have written a letter in my personal capacity to Principal 
Secretary Home, Uttar Pradesh as regards the alleged use of abusive words against one 
SI Sri Raghuraj Singh Bhati by SSP Muzaffarnagar Ms Manjil Saini and his sending his resignation as a consequence.

I personally talked to Sri Rathi who told me that he sent his resignation after feeling hurt and humiliated due to abjectly abusive words by the SSP though the matter had now been sorted.

In view of this incidence, I presented the incidence of the huge uproar
 caused due to alleged use of foul language last year by an IAS officer 
as Commissioner Basti against  SP Siddharthnagar where many IPS officers
 had allegedly tendered their resifnation. 

I have said that in
 the same manner, efforts shall be made to ensure that even the IPS 
officers do not use abusive language against their subordinate police 
officers so that a new, open and mutually respectful working environment
 gets created in the Police Department.

    <description>&lt;pre&gt;LUCKNOW: One week after an RTI query showed the Samajwadi Party government had not hosted even oneJanata Darshan programme in six months, the UP government announced on Monday that the programme will be held on June 4, albeit in the absence of chief minister Akhilesh Yadav. 

A government release on Monday evening said, "The chief minister will remain in Delhi for an additional day owing to a meeting. In his place, however, the Janata Darshan programme will be hosted by ministers and senior officials of the state government." 

One week ago, an RTI query, filed by Lucknow-based activist Urvashi Sharma had found that only seven Janata Darshan programmes were held at 5 Kalidas Marg since the SP government was sworn to power in March 2012. The mass contact programme was originally started by SP chief Mulayam Singh Yadav when he was chief minister of the state.

    <title>RTI applicable to Political Parties: Landmark decision of Central Information Co</title>

Final decision is given below, for ready reference. Political parties are "public authorities" as defined in section 2(h) of the RTI Act. Accordingly disclosure and dissemination of information under section 4 of RTI Act is their legal  obligation. 

CIC order mentions only section 4(1)(b) and there is need for sustained public pressure to ensure that entire obligations of public authorities are fulfilled by the political parties in letter and spirit. Political parties are expected to have high degree of probity, transparency and public accountability, setting an example for public administratiuon system.

" 90. The arguments of Shri Tiwari cannot be accepted by us in the light of statutory provisions and the case law referred to hereinabove and they have to be rejected. We may further add that his contention that NCP has received less than 1.55% of its total funding from the Government also cannot be accepted by us as he has not produced any figures before us to substantiate this claim. Further, assuming that these figures are true, this contention is liable to be rejected on the ground that NCP, being a Political Party, performs public functions, which along with other reasons mentioned above, qualifies it to be Public Authority under section 2(h). 

91. Yet another contention of Shri Tiwari is that if Political Parties are held to be Public
Authorities, then the political rivals would maliciously flood their CPIOs with numerous RTI applications at the time of elections thereby wasting their time and energy and, thus, causing detriment to their political functioning. In our view, the validity of a statute cannot be questioned only on the basis of presumption of its possible misuse. On the contrary, we are of the opinion that bringing the Political Parties in the ambit of RTI Act is likely to usher an era of transparency in their functioning. Besides it would result in strengthening of democracy and democratice institutions in the country. In view of the above discussion, we do not find any merit in the submissions of Adv. Tiwari and reject the same.

92. In view of the above discussion, we hold that INC, BJP, CPI(M), CPIO, NCP and BSP
have been substantially financed by the Central Government under section 2(h)(ii) of the RTI Act. The criticality of the role being played by these Political Parties in our democratic set up and the nature of duties performed by them also point towards their public character, bringing them in the ambit of section 2(h). The constitutional and legal provisions discussed herein above also point towards their character as public authorities. The order of the Single Bench of this Commission in Complaint No. CIC/MISC/2009/0001 and CIC/MISC/2009/0002 is hereby set aside and it is held that AICC/INC, BJP, CPI(M), CPI, NCP and BSP are public authorities under section 2(h) of the RTI Act. 

93. The Presidents, General/Secretaries of these Political Parties are hereby directed to
designate CPIOs and the Appellate Authorities at their headquarters in 06 weeks time. The CPIOs so appointed will respond to the RTI applications extracted in this order in 04 weeks time. Besides, the Presidents/General Secretaries of the above mentioned Political Parties are also directed to comply with the provisions of section 4(1) (b) of the RTI Act by way of making voluntary disclosures on the subjects mentioned in the said clause."

    <title>A completely concocted story</title>

Friends,

I would begin by saying that as far as I know, the story I am 
presenting here is a completely fallacious and imagined one. All its 
characters are also fictitious. I don’t even think that such illegal 
acts can actually be done in real life.  And this has certainly nothing to do with me in any manner. 

The problem is that this story repeatedly comes in my dreams and it haunts me all the time I am trying to sleep. The only remedy that I can think of to save my life and my peace of mind is to narrate 
the story before everyone so that it no longer remains confined only to 
my dreams and I get rid of its constant haunting. 

Once upon a 
time, there was a man. He was also an officer. As luck would have it, he
 also was a police officer. He was a bit independent minded and was not 
servile in his nature. As a result he often refused to toe the line 
dictated by others. This often brought him in conflict with his senior 
officers.

This officer was posted somewhere. Here also the same
 thing happened. This made the senior officer unhappy with him and he 
started having grudge with this officer. There must have been bad luck 
lurching somewhere around because at the same time, he somehow developed
 friction with his immediate subordinate. Interestingly, both the senior
 and the junior officer had excellent relations with each other. 

The senior officer was asked to conduct an enquiry in a given matter. 
He immediately got in unison with the subordinate officer and framed a 
false but thick and genuine looking report indicting this officer with 
extremely serious criminal charges. This report declared this officer as
 being involved in a very serious crime. 

The story was 
sensational and the report quite thick. It was immediately lapped by 
newspaper reporters and many news items got published making a complete 
villain out of this officer. 

When the news appeared in many 
prominent newspapers, the Lord also got concerned. The Lord entrusted 
this enquiry to a pretty senior officer. Since our officer was truly 
innocent he was found so in the independent enquiry conducted by this 
senior officer of the Lord. He declared through his enquiry report that 
this officer was not guilty in any manner. 

This officer, whom 
others had tried to frame with very serious charges was equally 
stubborn.  He was not happy by being declared innocent and not-guilty. 
He also started demanding suitable action against all those officers who
 tried to frame him on false charges in a false case. 

He has 
been pursuing his case for years though no one seems to be listening to 
him and his story. Everyone is advising him to forget the episode as a 
bad dream and to look forward instead of getting fixated in time and 
space. But this officer says that he would go on pursuing the matter as 
long as he can. 

While all this was still going on, this 
officer decided that he would present his truth before the common 
masses. He searched his rule books and found that in his service, there 
is a provision of speaking out his facts through media after having 
taken the due permission of his Lord. The rule was that he needed to 
apply to his Lord to grant him permission to speak out and if there was 
no response from the Lord till a specified period, then it would be 
presumed that such a permission had actually been granted by the Lord. 

The officer sought permission from his Lord. The Lord did not care to 
respond. The stipulated period passed off. The officer, thinking and 
presuming that now he that the right to interact with the media, called 
the media persons for interaction. 

Suddenly his Lords 
developed cold feet. They started thinking of the repercussions of this 
Press interaction. In a hurried manner, they disused the fact among 
themselves and made a decision that the officer would not be permitted 
to interact with the media. No reasons were provided for this decision, 
only an order of this nature was dispatched. 

It is month’s 
since this happened. Till date there has been no further progress in 
this matter. The officer has been writing incessantly, praying with 
folded arms to clarify the situation. He has been repeatedly saying that
 when the stipulated time period had passed, the Lord did not have a 
legal right to stop him from any Press interaction. He has been yelling 
at the top of his voice that he was been incorrectly and illegally 
gagged. He quotes various legal provisions including the Constitutional 
Articles related with freedom of expression but the Lord seems least 
bothered about these trivialities. In all certainty, the Lord regards 
himself as the law unto itself. 

Thus the position today is 
that the Lord is sitting there relaxed, considers himself the law of the
 land personified.  He also knows that the person struggling before him 
is nothing more than a mere servant. And he very well knows the limits 
of status and power that servants wield. To the Lord whatever he says is
 the only truth, whether being true or false, legal or illegal, 
constitutional or unconstitutional. 

The only problem is this 
case is that the concerned officer is also very belligerent and 
foolhardy. He has the bad habit of quoting rules and regulations. He is 
also willing to face any adversities in his self-declared path of 
justice. Despite knowing that his Lord will feel bad about these acts, 
he still keeps harping over the same issue again and again. 

This tug of war has been going for years. Prima facie is seems that what
 the officer says is legally correct because as per law, an officer 
seems to suo motu get the sanction to speak through media, the moment 
the requisite prescribed period after date of submission of the request 
is over. But then it is well known that the Lord is the ultimate king 
and he always considers himself above all laws. He is neither giving the
 officer permission to speak out nor is he stating any position to him. 
He is as relaxed as ever, while the officer is moving from pillar to 
post- feeling agitated and perturbed. 

It needs to be seen what 
course of events will this war between authority and legality will take 
further. But what is of real concern to me is the incessant persistence 
of this dream sequence that comes again and again in my sleep and is 
making my life miserable. I only hope, I am able to exorcise this ghost 
sooner so as to get fine and tranquil sleep. 

Would be great if my friends, by responding to this story, assist me in getting back my sleep.

It does really pain when one finds senior 
officers getting penalized from judicial and quasi-judicial forums. The 
last few says saw a very large number of senior UP Government officers 
being indicted severely by the Hon’ble High Court for their alleged 
contemptuous acts. 

Today I saw one such case before me when in 
one of my matters the Chief Information Commission, Uttar Pradesh  Sri 
Ranjit Singh Pankaj ordered imposition of a penalty of Rs. 25,000 on a 
senior police officer, IG Karmik in the DGP Office.  The CIC ordered 
this penalty for alleged intentional denial of information to me despite
 repeated orders. 

Actually I had sought certain information from
 DGP office about one of my poetry collection by the name “Atmadarsh”. 
The matter went from the Public Information Officer to the First 
Appellate Authority to the Information Commission. When the information 
was not provided, on last date of hearing on 02 April, the CIC issued 
certain strict directions.  

Today during the course of the 
hearing, when the CIC found that the required information was not given,
 instead a reply giving certain alibi for not providing the information 
was presented, he ordered the imposition of this fine. 

What 
hurts me is the fact that even we, the senior officers in the 
Government, seem to be violating laws, while we have ourselves been 
appointed for imposing law in the society. Again it hurts to know that 
many of the government servants don’t seem to understand the RTI Act and
 its beneficiary effects. RTI Act is a simple act which has opened the 
vistas of governance to the common people and we must all honour its 
dictate instead of sulking over it. We must also understand the nuances 
of the RTI act in its fullness so as to be of assistance and support to 
common people. 

The moment each government servant understands 
the fact that he is there to apply and executive laws and are not law 
unto themselves and they start having healthy attitude towards laws, 
including the RTI Act, many of the problems being faced by common masses
 presently will automatically evaporate in a jiffy.

The real Question is- “Will they?”

When I and wife Nutan had filed a Writ Petition in Allahabad High Court, Lucknow Bench in May 2012 as regards section
79 of the IT Act and  Information Technology (Intermediaries guidelines) Rules 2011 where Rule 11 says that the
intermediary shall publish on its website the name of the Grievance Officer andhis contact details, we never knew there would be so
many twists and turns in the sory and so many unknown facts will come in open. 

The latest fact in our knowledge came through the order of the Secretary of the Electronics and IT Department , Government of India. 
It has an Annexure attached with it which us as regards the meeting chaired by IT and Electronics Minister on 29 November 2012.
 
In the minutes of the Meetings at Annexure to the Secretary’s order it is clearly written that all Internet Service Providers (ISPs) in India have
implemented the provisions of the IT Rules and have accordingly designated Grievance Officers. But the foreign ISPs are not complying with 
the provisions of the Rules. 
 
In the meeting it also came to fore that while the foreign ISPs say designating Grievance officers is not practical and request that a particular 
email may be notified to enable grievances to be redressed,   many a times this is also not being followed.
 
The minutes of the meetings talk of Department’s Group Coordinate Dr Gulshan Rai mentioning that such a case of designating emails for posting 
grievances did not work in the recent past. The Government posted the grievances and the request for disabling such an information to Twitter. 
However, there was  no response from Twitter nor was any action taken on the requests made by the Government. Later itwas admitted by 
Twitter that they could not locate the said request made from the Government to the designated email account. 
As a consumer and as a concerned person of this Nation, our endeavour is only to assist in getting rid of this situation. At the same time, it looks 
rather strange to know that a Government Department could not enforce its writ and its own rules, that too from commercial organizations. 
To me it seems that the reason  for such a situation is not the company’s extended will but the lack of appropriate will to ensure the law of the land. 
The moment the law enforcing agencies decide not to allow any foreign company to violate the laws, no company will dare to do so. These 
Service Providers are earning crores of rupees from this country, they will never try to lose this market. Hence, it is time all the law enforcing agencies 
understand this fact in its totality.

मामले में दर्ज हत्या व हत्या की साजिश रचने के  मुक़दमे में आरोपित सेवारत पुलिस कार्मिकों
को तत्काल निलंबित करने, निमेष आयोग की रिपोर्ट को सार्वजनिक करने में देरी करने के   दोषियों के नाम खालिद मुजाहिद की हत्या की
साजिश रचने के  मुक़दमे में  शामिल करने ,तारिक कासमी और ऐसे अन्य मुसलमानों  के जीवन की सुरक्षा व्यवस्था इमानदार
कार्मिकों को सौपने एवं  जेल में बंद
बेगुनाह मुसलमानों को राज्य सरकार द्वारा रिहा कराने का  निर्णय लेते समय
ही ऐसे बेगुनाहों को झूठे मामलों में फंसाने बाले
लोकसेवकों/व्यक्तियों के विरुद्ध अभियोग पंजीकृत कराने और  ऐसे बेगुनाह
मुसलमानों को समाज की मुख्य धारा में लाने के लिए मुआवजे के साथ
सरकारी नौकरी दिए जाने का निर्णय भी लिए जाने के
सम्बन्ध में मांगपत्र

UN Report: Preventing &amp;amp; Combating Corruption in Public Services- 1 -2199- India-Chief Minister's Office- Mass Contact Programme (MCP)-1 First Place.

Neither People of Kerala aware nor any of the media has published much  news on Chief Minister resolving cases of complaint of corruption of public servants during any of his Mass Contact Programmes. My own complaint with all documentary evidences was not given any consideration in any of CM's Mass Contact Programmes. Its follow ups in his own Web site found neglected. When contacted CM's Office on phone, the reply was that when the Tahsildar does not obey them what they can do ?

    <description>&lt;pre&gt;अदालत में दिए प्रार्थना पत्र में उर्वशी शर्मा का कहना है कि रमाबाई मैदान में गत छह मई को सहारा इंडिया परिवार द्वारा आयोजित भारत भावना दिवस में राष्ट्रध्वज का अपमान किया गया था। राष्ट्रगान समारोह में उपस्थित लोगों ने एक साथ राष्ट्रगान गाने का विश्व रिकार्ड तो बना लिया, लेकिन राष्ट्रगान गाने के कार्यक्रम के बाद राष्ट्रध्वज
 तिरंगे को पैरों तले रौंदा गया। जिसके चित्र समाचार पत्रों में भी प्रकाशित हुए थे। तिरंगे के इस सार्वजनिक अपमान के चित्र देखकर उर्वशी ने नौ मई को इस संबंध में सुब्रत राय एवं सहारा इंडिया परिवार के उत्तरदायी अधिकारियों एवं कार्मिकों के विरुद्ध राष्ट्रीय गौरव अपमान अधिनियम 1971 की धारा 2 के तहत प्रथम सूचना रिपोर्ट दर्ज कर कानूनी कार्यवाही के लिए एक प्रार्थना पत्र थाना
 तालकटोरा को दिया। 

उर्वशी के अधिवक्ता त्रिभुवन कुमार गुप्ता ने बताया कि इस मामले में परिवाद रिपोर्ट का अवलोकन करने के बाद मजिस्ट्रेट ने मामले की जांच के लिए परिवाद को आशियाना थाने भेजने के आदेश के साथ दो दिनों में में आख्या तलब की है। मामले में अगली सुनवाई के लिए 23 मई निर्धारित किया गया है।
